1. Build & Deliver Plans (One-Time Payment)
1.1 Full Refund Eligibility
You are eligible for a 100% refund in the following circumstances:
- Non-Delivery: If we fail to deliver your website within 7 business days of payment confirmation and you have provided all required content/materials.
- Technical Failure: If the delivered website has critical technical issues that prevent it from functioning as a standard website (broken forms, non-responsive design, major browser compatibility issues) and we cannot fix them within 48 hours of notification.
- Severe Quality Issues: If the delivered website materially deviates from the specifications in your intake form and we cannot rectify it within your included revision rounds.
1.2 NO Refund After Acceptance
NO REFUNDS will be issued once you have:
- Received the final website delivery AND used all included revision rounds
- Accepted the final delivery in writing (email confirmation)
- Passed 14 days since initial delivery without requesting revisions
- Made the website publicly accessible or started using it for business
- Requested changes outside the original scope (scope creep does not qualify for refunds)
1.3 Partial Refunds
In cases where work has begun but cannot be completed:
- If you cancel after initial delivery but before revisions: 50% refund may be offered at our discretion
- If LaunchKernel determines the project is not feasible due to technical constraints disclosed after payment: Pro-rated refund based on work completed
- All partial refund decisions are final and at LaunchKernel's sole discretion
2. Managed Monthly Plans (Subscriptions)
2.1 Setup Fee (Non-Refundable)
The initial setup fee for Managed Monthly plans is 100% NON-REFUNDABLE once work begins. This covers:
- Initial website design and development
- AI content generation
- GitHub repository setup
- Netlify deployment configuration
- Domain configuration services
2.2 Monthly Subscription Cancellation
You may cancel your Managed Monthly subscription at any time with the following terms:
- Notice Period: 30 days written notice required (email to support@launchkernel.com)
- Pro-Rated Refunds: NO pro-rated refunds for partial months. You retain access through the end of your billing cycle.
- Access After Cancellation: Upon cancellation, full code ownership is transferred to you. Hosting and maintenance support cease at end of billing period.
- Re-Activation: If you wish to re-activate after cancellation, a new setup fee may apply
3. Refund Request Process
3.1 How to Request a Refund
To request a refund, you must:
- Email support@launchkernel.com with subject line: "Refund Request - Order #[YOUR_ORDER_ID]"
- Provide your order number, business name, and reason for refund request
- Include documentation of any quality issues (screenshots, specific examples)
- Allow 3-5 business days for review and response
3.2 Refund Processing Timeline
Approved refunds are processed as follows:
- Review Period: 2-5 business days to review your request
- Approval Notification: Email notification of decision
- Refund Processing: 5-10 business days for funds to appear in original payment method
- Total Time: Up to 15 business days from request to funds received
4. Chargeback Prevention
⚠️ Important: Do Not File Chargebacks
Filing a chargeback instead of following our refund process may result in:
- Immediate Account Suspension: Your account and all services will be terminated
- Loss of Code Access: Access to GitHub repository and Netlify hosting will be revoked
- Legal Action: Fraudulent chargebacks may result in legal proceedings to recover losses plus legal fees
- Blacklist: You will be permanently banned from using LaunchKernel services
- Credit Card Dispute Fees: You will be liable for chargeback fees ($25-$100 per occurrence)
We encourage open communication. If you're unhappy with our service, contact us first. We're committed to resolving issues fairly.
5. What is NOT Eligible for Refunds
The following circumstances do NOT qualify for refunds:
- Change of Mind: "I don't need a website anymore" or "I found another provider"
- Subjective Preferences: "I don't like the color scheme" (when revisions were offered but not used)
- User Error: Providing incorrect information in intake form that results in incorrect content
- Third-Party Issues: Domain registrar problems, DNS issues, hosting issues outside our control
- Business Failure: Your business closing or changing direction after delivery
- Feature Requests: Wanting features beyond your original plan scope
- Competitor Preference: Switching to competitor after receiving deliverables
- Time Delays (Your Side): Project delayed due to your unavailability or slow content provision
- Revision Exhaustion: Using all included revisions and then requesting more changes
6. Modification and Cancellation Before Delivery
6.1 Cancellation Before Work Begins
If you cancel before we start building your site (typically within 24 hours of payment):
- Full refund minus processing fees (3-5% Stripe fees non-recoverable)
- Must request via email within 24 hours of payment
- Refund processed within 5-7 business days
6.2 Cancellation After Work Begins
If you cancel after we've started work:
- No refund available - work has been performed and cannot be "returned"
- You will receive all work completed to date
- Partial deliverables will be provided (GitHub repo, any completed pages)
- No refund will be issued
7. Force Majeure & Service Interruptions
LaunchKernel is not liable for delivery delays or service interruptions caused by:
- Third-party service outages (GitHub, Netlify, Anthropic, Stripe)
- Natural disasters or acts of God
- Government actions or regulations
- Pandemics or public health emergencies
- Internet infrastructure failures
- Cyber attacks or security breaches affecting third parties
In such cases, delivery timelines will be extended by the period of interruption. No refunds will be issued for force majeure delays.
8. Limitation of Liability & Damages
Maximum Liability Cap
LaunchKernel's total liability to you for any claims arising from our services is limited to the amount you paid for the service (setup fee for managed plans, or full payment for build-only plans).
We are NOT liable for:
- Lost Profits or Revenue: We are not responsible for any business revenue lost due to website delays or issues
- Indirect Damages: Consequential, incidental, punitive, or special damages
- Third-Party Claims: Claims from your customers or users
- Data Loss: Loss of content or data (maintain your own backups)
- SEO Rankings: We do not guarantee search engine rankings or traffic
- Conversion Rates: We do not guarantee your website will generate sales or leads
- Competitor Actions: If competitors copy your design or content
- Platform Changes: If GitHub, Netlify, or other platforms change their services
9. Scope Changes & Additional Fees
If you request changes outside the original scope:
- Additional pages beyond plan limits: $250-$500 per page
- Custom functionality not in original scope: Quote provided separately
- Rush delivery (under 24 hours): +50% of original price
- Content rewriting after AI generation: $150/page
Important: Additional fees must be paid before work begins. No refunds on additional fees.
10. Refund Processing Method
All approved refunds are processed via:
- Same Payment Method: Refunded to the original credit card or payment method used
- No Cash Refunds: We do not issue refunds via cash, check, or wire transfer
- Processing Time: 5-10 business days after approval for funds to appear
- Stripe Fees: Original processing fees (3-5%) are non-refundable
11. Dispute Resolution
Before pursuing legal action or chargebacks:
- Contact Support First: Email support@launchkernel.com with detailed concerns
- Allow 48 Hours: Give us two business days to respond and propose resolution
- Escalation: If not resolved, request escalation to management
- Mediation: Both parties agree to good-faith mediation before litigation
Binding Arbitration: By using LaunchKernel, you agree that any disputes will be resolved through binding arbitration, not court proceedings (except small claims court). This reduces legal costs for both parties.
12. What We Guarantee
LaunchKernel guarantees:

- ✅ Website will be mobile-responsive and work on modern browsers
- ✅ All forms will function properly
- ✅ Code will be free of critical bugs at delivery
- ✅ Website files will be provided via GitHub
- ✅ Professional customer support during business hours
13. What We Do NOT Guarantee
No Performance Guarantees
We do NOT guarantee:
- ❌ Specific Google rankings or SEO results
- ❌ Website traffic or visitor numbers
- ❌ Lead generation or conversion rates
- ❌ Sales or revenue from your website
- ❌ Social media engagement or followers
- ❌ Compatibility with future browser versions or standards
- ❌ Uptime beyond what our hosting providers (Netlify) guarantee
- ❌ That AI-generated content will be perfect without review
14. Your Responsibilities
To qualify for refunds, you must:
- Provide complete and accurate information in the intake form
- Respond to our communications within 48 hours
- Provide requested content, images, or materials promptly
- Review delivered work within the revision window (14 days)
- Report issues immediately (not months later)
- Use included revision rounds before claiming quality issues
- Follow our refund request process
15. Special Circumstances
15.1 Abandoned Projects
If you become unresponsive for 30+ days after payment:
- Project considered abandoned - no refund available
- Partially completed work delivered to you as-is
- Project closed, no further work performed
15.2 Mutual Termination
If both parties agree the project cannot be completed:
- Partial refund negotiated based on work completed
- Written mutual termination agreement required
- All work completed to date delivered to you
16. Policy Changes
LaunchKernel reserves the right to modify this refund policy at any time. Changes apply to purchases made after the policy update date. Your purchase is governed by the policy version in effect at the time of purchase.
