1. Agreement to Terms

By accessing and using LaunchKernel's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

LaunchKernel is part of the ResilientMind AI Ecosystem, a suite of AI-powered tools designed to enhance productivity and business operations.

2. Service Plans

2.1 Build & Deliver Plans

Build & Deliver plans are one-time services where we create and deliver your website:

• Payment is a one-time fee based on the selected plan (Starter, Standard, or Pro)
• Website delivery within 24-48 hours of payment confirmation
• Full code and asset ownership transferred upon delivery
• Includes specified number of revision rounds per plan
• No ongoing fees or platform lock-in

2.2 Managed Monthly Plans

Managed Monthly plans include initial setup plus ongoing maintenance:

• Initial setup fee charged at order placement
• Monthly recurring subscription for hosting, updates, and support
• Monthly billing begins 30 days after initial delivery
• Can be cancelled at any time with 30-day notice
• Upon cancellation, full code and assets are transferred to you

3. Revision Policy

Each plan includes a specified number of revision rounds:

• Revisions must be requested within 14 days of initial delivery
• A revision round includes reasonable changes to content, layout, and styling
• Scope changes or additional pages require plan upgrades
• Revisions are typically completed within 2-3 business days

4. Intellectual Property Ownership

4.1 Your Ownership

Upon full payment, you own all rights to:

• Website source code and custom components
• AI-generated content created for your site
• Images and assets (subject to third-party licenses)
• Design elements specific to your site

4.2 LaunchKernel Ownership

LaunchKernel retains ownership of:

• Template frameworks and reusable components
• Build automation and generation systems
• LaunchKernel branding and marketing materials

5. Payment Terms

• All payments are processed securely through Stripe
• Prices are in USD and include all applicable taxes
• Refunds available if site is not delivered within 7 business days
• No refunds after delivery and acceptance of the final website
• Monthly subscriptions can be cancelled at any time

6. Service Limitations

While we strive for excellence, please note:

• AI-generated content may require review and editing
• Complex functionality may require custom development (additional fees)
• Third-party integrations are subject to their terms and availability
• We do not guarantee specific search engine rankings

7. Limitation of Liability

LaunchKernel and ResilientMind AI shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Issues arising from third-party services or hosting providers
• Damages exceeding the amount paid for services

8. Warranties and Disclaimers

Services are provided "as is" without warranties of any kind. We warrant that:

• Delivered websites will function as demonstrated
• Code will be free of known critical bugs at delivery
• Sites will be compatible with modern browsers

9. Termination

Either party may terminate the agreement:

• You may cancel managed services with 30-day notice
• We may terminate for non-payment or terms violations
• Upon termination, you retain all delivered work

10. ResilientMind AI Ecosystem

LaunchKernel is part of the ResilientMind AI Ecosystem. By using our services, you may receive information about other ResilientMind AI products and services. We respect your privacy and will never share your information without consent.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of services after changes constitutes acceptance of new terms. Material changes will be communicated via email.
